These Terms of Use and Informed Consent govern access to and use of My Functional Journey, the upcoming individual-facing application operated by Global Human Biomechanics Intelligence Systems, Inc. (“GHBI,” “we,” “us”). By checking the required box and electronically signing in the app, you confirm that you had the opportunity to read this document and the My Functional Journey Privacy Policy and that you voluntarily agree to the processing described below.

Informational, non-diagnostic application

My Functional Journey uses artificial intelligence, computer vision and organizational tools to help users collect, organize, visualize and understand functional-health information over time. It does not diagnose disease, prescribe treatment, replace a licensed professional, establish a clinician-patient relationship with GHBI or provide emergency care. Outputs may be incomplete, inaccurate or inappropriate for an individual situation and must not be used as the sole basis for a medical decision.

If you believe you may have an emergency, call 911 or the appropriate local emergency number. Do not delay professional evaluation because of information produced by the app.

Information covered by your authorization

Depending on the features you use, you authorize GHBI to collect and process account and authentication information; symptoms, activities, goals, medications, exercises, questions, surveys and patient-reported outcomes; photos, videos, audio and camera captures; posture, mobility, body-landmark and measurement information; documents you upload, including medical records; optional demographic information; prompts and AI outputs; device and usage information; consent records; and communications with GHBI.

Operating-system permissions for the camera, microphone, photo library or health data will be requested when the related feature is used and remain subject to your device settings.

AI-assisted processing and model improvement

GHBI may use AI and automated methods to extract functional measurements, organize a longitudinal functional timeline, summarize information, identify changes, support educational explanations and compare measurements with appropriately constructed groups of similar records.

By accepting and signing in the app, you expressly authorize GHBI to use eligible captures, posture and mobility measurements, body-landmark data, functional labels, survey responses and appropriately de-identified or anonymized derived information to develop, train, test, validate, monitor and improve GHBI’s AI and functional-intelligence technology. This authorization does not permit GHBI to sell your personal health information or use it for third-party behavioral advertising.

If applicable law requires a separate or more granular permission for a particular use, GHBI will present the legally required control before that processing begins.

Captures and derived functional data

A capture can contain more identifying information than a name or face. Before eligible captures or information are placed into a model-improvement dataset, GHBI will apply safeguards designed to remove, obscure or transform direct identifiers and unnecessary image content, such as facial detail, background, location metadata, file names and exact dates, when technically applicable.

GHBI may convert captures into derived functional data, including body landmarks, vectors, joint or posture angles, symmetry measurements, motion patterns, quality indicators and functional labels. Removing a face does not automatically make information anonymous. Information that remains reasonably linkable to a person will continue to be treated as protected personal information.

Deleting a source image does not necessarily delete derived functional data lawfully created from it. GHBI may retain and use data that has been irreversibly anonymized so that it is no longer reasonably linkable to you. Linkable or identifiable derived data remains subject to applicable privacy rights and verified withdrawal or deletion requests.

Uploaded medical or health records

The app may allow you to upload records so the system can organize or explain their content for your use. GHBI does not become the author of those records and cannot guarantee that they are complete or correct. GHBI will not place an identifiable copy of an uploaded medical record into a general model-training dataset. Limited characteristics or derived functional information may be used for model improvement only after appropriate minimization, de-identification or anonymization and access safeguards. Additional authorization will be obtained where required by law.

Providers and telehealth

At your request, the app may help you identify or contact an independent licensed provider. GHBI will obtain any additional authorization required before transmitting identifiable information to a provider. The provider, not GHBI, is responsible for professional judgment, licensure, telehealth consent, diagnosis, treatment, documentation and follow-up. Availability depends on the user’s physical location and the provider’s legal authorization to practice there. Provider services, fees, scheduling, cancellation and payment terms will be disclosed before a consultation is purchased or scheduled.

Your responsibilities and prohibited use

You must provide accurate information, safeguard your account and use the app lawfully. Do not upload another person’s information unless you have legal authority and permission. You may not attempt unauthorized access, interfere with security, introduce malicious code, impersonate another person, upload unlawful or infringing material, reverse engineer where prohibited or use app outputs as a substitute for emergency or licensed medical care.

Your content and GHBI intellectual property

You retain rights in content you lawfully submit. You grant GHBI the limited rights necessary to host, process, secure, provide and improve the services as expressly described in this agreement and the Privacy Policy. The application, software, interfaces, documentation, trademarks, models and original GHBI materials remain owned by or licensed to GHBI. These Terms do not transfer ownership to you.

Withdrawal, deletion and retention

You may withdraw authorization for future AI model-improvement use by emailing service@globalbiomechanicsai.com from the email associated with your account and stating that you withdraw AI-training consent. GHBI may reasonably verify your identity. A verified withdrawal stops new account-linked information from being placed into future model-improvement datasets and triggers removal of identifiable or linkable source records from active training datasets when legally required and technically feasible.

Withdrawal does not make prior lawful processing unlawful. Previously and irreversibly anonymized information, aggregated statistics and model parameters that do not contain, reveal or permit extraction of personal information may remain when continued use is lawful. You may request account and data deletion through the in-app control or the public deletion page. Uninstalling the app alone does not close the account or delete server-held information.

Security and processing providers

GHBI uses administrative, technical and organizational safeguards appropriate to risk, including planned encryption, role-based access, audit logging, separation of identifying information from training data and deletion controls. My Functional Journey may use Microsoft Azure and other contracted providers described in the Privacy Policy. No system can guarantee absolute security.

Risks and potential benefits

Potential benefits include organizing information, visualizing functional change, supporting more informed conversations and improving future functional-measurement technology. Risks include incorrect AI output, privacy loss, unauthorized access, reidentification, emotional concern, inappropriate reliance on informational results and dataset limitations or bias. Safeguards reduce but cannot eliminate these risks.

Children and eligibility

My Functional Journey is not directed to children under 13. Age, parental authorization and consent requirements may differ by jurisdiction. GHBI may impose a higher minimum age or require a parent or legal guardian where applicable.

Availability, disclaimers and limitation of liability

My Functional Journey is upcoming and under development. Features may be tested, changed, suspended or discontinued. To the extent permitted by law, the app is provided “as is” and “as available.” GHBI disclaims implied warranties and is not liable for indirect, incidental, special or consequential damages. Mandatory consumer protections in your jurisdiction are not waived.

Changes, governing rules and contact

GHBI may update these Terms prospectively. If a change materially expands how sensitive information is used, GHBI will provide a new notice and request renewed consent when required. Unless mandatory law provides otherwise, these Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
