Privacy Policy
Effective August 28, 2026. This policy applies only to My Functional Journey. XOX26 has a separate privacy policy and separate data practices.
This Privacy Policy explains how Global Human Biomechanics Intelligence Systems, Inc. (“GHBI,” “we,” “us”) may collect, use, disclose, retain and protect information in My Functional Journey, our upcoming individual-facing mobile application. It should be read with the Terms of Use & Informed Consent.
Information we may collect
- Account, profile, authentication, contact, subscription and transaction information.
- Functional-health information, including symptoms, activities, goals, medications, exercises, questions, surveys and patient-reported outcomes.
- Photos, videos, audio, camera captures, posture or mobility observations, body landmarks, angles and other measurements.
- Documents you choose to upload, which may include medical or health records.
- Prompts, questions, summaries, AI outputs and measurements derived from information you submit.
- Optional demographic information, including age range, sex, language and self-reported racial or ethnic background.
- Device, application, log, crash, performance, consent, fraud-prevention, security and usage information.
- Communications and support requests.
How information is collected
Information may be provided directly by you, captured through features you choose to use or collected automatically through application, device, security and usage logs. Camera, microphone, photo-library and health-data permissions are requested when the related feature needs them, remain subject to operating-system controls and can be changed in device settings.
AI-assisted processing
GHBI may use artificial intelligence, computer vision and automated methods to extract functional measurements, organize a longitudinal functional timeline, summarize information, identify changes, support educational explanations and compare measurements with appropriately constructed groups of similar records. AI outputs may be incomplete or inaccurate and are not a medical diagnosis, prescription, emergency service or substitute for licensed professional judgment.
AI model improvement authorization
When a user accepts and electronically signs the Terms of Use & Informed Consent in the app, the user expressly authorizes GHBI to use eligible captures, posture and mobility measurements, body-landmark data, functional labels, survey responses and appropriately de-identified or anonymized derived information to develop, train, test, validate, monitor and improve GHBI’s AI and functional-intelligence technology.
This authorization is recorded with the agreement version, date and time, account identifier and electronic-signature record. If applicable law requires a separate or more granular permission for a particular processing activity, GHBI will provide the legally required control before that processing begins.
Captures and derived functional data
A capture can contain more identifying information than a name or face. Before eligible captures or information are placed into a model-improvement dataset, GHBI will apply safeguards designed to remove, obscure or transform direct identifiers and unnecessary image content, including facial detail, background, location metadata, file names and exact dates, when technically applicable.
GHBI may convert captures into derived functional data, including body landmarks, vectors, joint or posture angles, symmetry measurements, motion patterns, quality indicators and functional labels. Removing a face does not automatically make information anonymous. Information that remains reasonably linkable to a person continues to be treated as protected personal information.
Deleting a source image does not necessarily delete derived functional data lawfully created from it. GHBI may retain and use derived information that has been irreversibly anonymized so that it is no longer reasonably linkable to an individual. Linkable or identifiable derived data remains subject to applicable privacy rights and verified withdrawal or deletion requests.
Uploaded medical or health records
The application may allow you to upload records so the system can organize or explain their content for your use. GHBI will not place an identifiable copy of an uploaded medical record into a general model-training dataset. Limited characteristics or derived functional information may be used for model improvement only after appropriate minimization, de-identification or anonymization and access safeguards. Additional authorization will be obtained where required by law.
How we use information
GHBI may use information to provide and personalize application features; create and secure accounts; organize a functional timeline; process captures and requested AI features; provide support; communicate service or policy changes; prevent fraud and abuse; maintain, test and improve performance; develop authorized model improvements; comply with law; and protect users, GHBI and others.
Providers and telehealth requests
At your request, the app may help you identify or contact an independent licensed provider. GHBI will obtain any additional authorization required before transmitting identifiable information to a provider. Providers remain responsible for licensure, professional judgment, telehealth consent, diagnosis, treatment, documentation and follow-up. Eligibility depends on the user’s physical location and the provider’s authorization to practice there.
Sharing and service providers
GHBI may disclose information to a provider or organization at your direction; contracted vendors that host, secure, analyze, process or support the application; professional advisers; authorities when legally required; or a successor in a lawful corporate transaction. Providers may process information only for authorized purposes and under applicable contractual, confidentiality, security and data-protection requirements.
My Functional Journey may use Microsoft Azure and other providers identified by GHBI. GHBI plans to use encryption, role-based access, audit logging, separation of identifying information from training data, secure cloud infrastructure and deletion controls appropriate to risk. Use of a cloud provider does not by itself guarantee compliance, and no system can guarantee absolute security.
No sale, behavioral advertising or facial identification
GHBI does not sell personal health information or share it for third-party behavioral advertising. GHBI does not use facial-recognition technology to identify users from functional captures and will not infer racial or ethnic identity from a person’s face.
Retention, deletion and withdrawal
GHBI retains information only for the purposes and periods reasonably described here, including service delivery, security, legal obligations, dispute resolution and authorized model improvement. Retention may differ by information type, account status, jurisdiction and whether information has been irreversibly anonymized.
Uninstalling the app removes it from the device but does not automatically close the account or delete server-held information. Account and data-deletion requests may be submitted through the in-app deletion control or the My Functional Journey Account & Data Deletion page.
You may withdraw authorization for future AI model-improvement use by emailing service@globalbiomechanicsai.com from the email associated with your account and stating that you withdraw AI-training consent. GHBI may reasonably verify your identity. A verified withdrawal stops new account-linked information from being placed into future model-improvement datasets and triggers removal of identifiable or linkable source records from active training datasets when legally required and technically feasible.
Withdrawal does not make prior lawful processing unlawful. Previously and irreversibly anonymized information, aggregated statistics and model parameters that do not contain, reveal or permit extraction of personal information may remain when continued use is lawful.
Your privacy choices and rights
Depending on your location, you may request access, correction, export, restriction or deletion; object to certain processing; withdraw consent where applicable; change device permissions; or appeal a privacy decision. GHBI may verify identity before acting. Exercising privacy rights will not result in unlawful discrimination, although some features cannot function without information necessary to provide them.
Children
My Functional Journey is not directed to children under 13. Product eligibility, parental authorization and consent requirements may differ by jurisdiction. GHBI may impose a higher minimum age where required.
International processing
Information may be processed in the United States or other approved locations where GHBI or its providers operate. Where required, GHBI will use regional hosting, processor agreements, contractual transfer safeguards or other lawful transfer mechanisms.
Changes and contact
GHBI may update this policy as the application, technology or law changes. If a change materially expands how sensitive information is used, GHBI will provide a new notice and request renewed consent when required.
